New York Gov. Kathy Hochul (D) is proposing legislation to crack down on unlicensed hashish storefronts within the state, together with fines of as much as $10,000 per day for illegal operations. The laws would additionally give further enforcement energy to the Workplace of Hashish Administration (OCM) and the Division of Taxation and Finance to implement the brand new regulatory necessities and shut shops engaged in hashish gross sales and not using a license. 

“The continued existence of unlawful dispensaries is unacceptable, and we want further enforcement instruments to guard New Yorkers from harmful merchandise and assist our fairness initiatives. I’m pleased with our continued progress creating the completely new authorized hashish trade and serving to authorized dispensaries open their doorways to supply safer hashish merchandise to New Yorkers.” — Hochul in a press release 

The brand new laws, which is being launched as a governor’s program invoice within the Senate and Meeting, amends the state’s tax legislation and adult-use hashish legislation to allow the OCM, the Taxation and Finance Division, and native legislation enforcement to implement restrictions on unlicensed storefront dispensaries. The laws doesn’t impose any new penalties associated to hashish possession by a person for private use and doesn’t permit native legislation enforcement to carry out enforcement actions in opposition to people. 

Along with the $10,000 per day fines, the laws would permit fines of as much as $200,000 for illegal hashish cultivation. 

In an announcement, OCM Government Director Chris Alexander entrepreneurs looking for to take part within the state’s authorized hashish trade “are being economically harmed by dangerous actors filling their storefronts with merchandise which can be questionable, unregulated and probably harmful.” 

The laws would restructure present illicit hashish penalties to offer taxation division peace officers enforcement authority, create a manageable, credible, truthful enforcement system, and would impose new penalties for retailers that evade state hashish taxes, the governor’s workplace stated. The proposal would additionally make clear and develop OCM’s authority to grab illicit product, set up abstract procedures for OCM and different governmental entities to close down unlicensed companies, and create a framework for more practical cross-agency enforcement effort.
